How to Submit a DMCA Notice

If you are a copyright holder or authorized to act on behalf of one, and you believe that material on our Website infringes your copyright, you may submit a written DMCA notice to us.

To ensure a valid and effective submission, your notification must include all of the following:

  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work(s) claimed to have been infringed.
  3. A detailed description of the material that is allegedly infringing and enough information to help us locate it (such as URLs or post titles).
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that the disputed use is unauthorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

Once a properly formatted and complete notice is received, we will review and take appropriate action, which may include removing or disabling access to the infringing material. In cases of repeated violations, user accounts may be suspended or permanently terminated.

We strongly recommend keeping backups of your content. We may not be able to restore removed material or recover terminated accounts.

Counter-Notification Process

If your content has been removed due to a DMCA notice, and you believe this was done in error or that the material was wrongly identified, you have the right to file a counter-notification in accordance with Sections 512(g)(2) and 512(g)(3) of the DMCA.

Your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and its location before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled due to mistake or misidentification.
  4. Your full name, address, phone number, and email address.
  5. A statement consenting to the jurisdiction of the federal court in your district (or, if outside the U.S., in any U.S. judicial district where Network Palava may be found), and that you will accept service of process from the complainant.

Upon receiving a valid counter-notification, we may restore the content within 10 to 14 business days unless the original complainant files a court action against you.

Please be aware that misuse of the DMCA process may lead to legal consequences.

No Obligation to Act

While we are committed to addressing copyright concerns in line with the law, Network Palava reserves the right to decline action on any DMCA notice or counter-notice that does not comply with the legal standards or that we believe to be fraudulent, abusive, or misused.

We also reserve the right to pursue any additional remedies available to us under the law for cases of repeated or egregious infringement.
